Washington Sports Betting 2026: Legal Status and Your Options

Washington has legal sports betting in person only at a tribal casino. There is no statewide mobile and no legal bet-from-home; under state law, placing a wager online is a felony. Is Sports Betting Legal in Washington?

Only in person at a tribal casino, that is the entire legal footprint. Washington legalized sports betting in 2020, restricted it to the tribal nations through their gaming compacts, and the first books opened in September 2021. Today around twenty tribal casinos run sportsbooks. Every wager, at a window, a kiosk, or on a casino app, has to happen on tribal land enforced by geofencing systems. Step off the property and you cannot legally bet.

There is no statewide mobile, period. Under RCW 9.46.240, knowingly transmitting or receiving gambling information online is a Class C felony in Washington, up to five years and a ten thousand dollar fine. It is one of the most restrictive states in the country on this.

The rest of Washington's legal gambling is a short, in-person list: tribal casino gaming, the state lottery, licensed card rooms, pari-mutuel horse racing, and charitable bingo and raffles (the Gambling Commission oversees the tribal, card-room, and charitable categories; the lottery and horse racing sit with separate state agencies). Unlicensed online betting and betting apps are treated as illegal. 

Why There's No Statewide Mobile

Washington built its market on tribal exclusivity: sports betting runs through the tribal nations under Class III compacts and it stays on their land. National brands are here only as retail partners on tribal property, one commercial mobile partner per tribe. DraftKings runs the books at Tulalip and Quil Ceda Creek, FanDuel at Suquamish's Clearwater, and Caesars and BetMGM operate at other properties. None can offer a statewide app you use from your couch.

That model already survived a direct challenge. Maverick Gaming, a commercial card-room operator, sued to break tribal exclusivity and lost at every level: the Ninth Circuit affirmed the dismissal in December 2024, and the Supreme Court declined the case in October 2025. The framework is settled for now.

The recent movement is SB 6137, the Sports Wagering Integrity Act, which Governor Ferguson signed on March 30, 2026, effective June 11, 2026. It lets tribal casinos take bets on in-state college teams (with player props on Washington college athletes off the table) and broadens operator access across tribal properties. Off-property statewide mobile is not part of it; the bet still has to happen on tribal land.

What Washingtonians Can Use

In Washington the list is short:

• Tribal casino sportsbooks (in person): the only settled, legal in-state option. Visit the property, bet on-site. Age is 18 or 21 depending on the casino

• Daily fantasy sports (DFS): closed. The WSGC treats paid DFS as illegal gambling, and the major operators exclude the state outright. PrizePicks lists Washington as ineligible for Player Picks, Team Picks and Culture Picks alike, leaving only its free-to-play product here, and Underdog marks both its Drafts and its Pick'em contests unavailable in Washington. Alongside Hawaii, Idaho, Montana and Nevada, Washington is one of five states where neither major DFS app operates. There is no paid DFS path here

• Prediction markets: the most contested category. A court has ordered Kalshi to stop most of its Washington markets, while Novig entered and sued to stay (covered below)

• Oregon, across the line: the nearest legal phone bet (covered below)

Washington is one of the strictest and longest-standing states on sweepstakes-style casino and sportsbook sites, which are effectively illegal here and geoblocked by the major platforms. Offshore sportsbooks are unregulated, with no Washington consumer protections behind them. 

Crossing Into Oregon

For a lot of Washington bettors, the nearest legal phone bet is on the other side of the Columbia. Oregon has legal statewide online sports betting through the Oregon Lottery, with DraftKings as the single operator, pro sports only, no college. A Washingtonian can bet from a phone legally the moment that phone is physically in Oregon. Idaho, to the east, has no legal sports betting, so that border does not help. These systems check your physical location, and access shuts off when you leave.

How prediction markets Work

prediction markets are the newer option, and the one whose Washington status is unsettled. The mechanics differ from a sportsbook: there is no house on the other side setting the line. You trade against other participants, or the market, on the outcome of an event, taking the best price on offer or posting your own. Because prices come from what participants are willing to trade at, they track the market rather than a book's built-in margin.

These platforms operate under federal oversight, not state sportsbook licensing. They are regulated by the Commodity Futures Trading Commission (CFTC) as markets for event contracts. Where they operate, eligibility comes down to age and physical location: exchanges generally require players to be 21 and over and physically in an eligible area no matter what.

Where Prediction Markets Stand in Washington

Prediction markets are the one phone-based category still operating in Washington in any form, and as of August 2026 the state has largely succeeded in closing it.

On March 27, 2026, Washington Attorney General Nick Brown sued Kalshi in King County Superior Court, alleging its event contracts are illegal gambling and violate the state's consumer-protection law. The suit seeks to shut Kalshi down in Washington, recover losses, and impose penalties. The Washington State Gambling Commission holds that these event contracts are a form of sports wagering, and Washington co-signed amicus briefs backing other states, alongside dozens of tribal entities, in the parallel federal cases. Kalshi and Polymarket were both denied emergency injunctions in the Ninth Circuit.

On August 13, 2026, a King County Superior Court judge ordered Kalshi to stop offering wagers on sports, elections, politics, entertainment, culture, tech and science in Washington, with geofencing due August 19 and September 2. The Court of Appeals refused a stay. 

Kalshi is under a court order covering most of its markets here; Polymarket's access is contested and was denied an injunction in the same circuit. Novig, the commission-free peer-to-peer exchange, secured a CFTC Designated Contract Market designation on June 16, 2026 and launched sports event contracts in 47 states on August 4, Washington among them. Rather than withdraw, Novig sued Washington in its first week, arguing federal commodities law preempts state gambling law. That case is pending. Nothing here is settled.

The Future of Sports Betting in Washington

Three things could change the picture.

• SB 6137, already law: the Sports Wagering Integrity Act took effect June 11, 2026. It lets tribal casinos take bets on in-state college teams, with player props on Washington college athletes off the table, and broadens operator access across tribal properties. That expands the tribal-retail market without creating off-property statewide mobile. What is left to watch is how it plays out in practice and whether the legislature ever revisits off-property mobile

• The prediction market cases: the Attorney General's suit produced an August 2026 injunction against Kalshi, and Novig's preemption suit against the state is pending. The broader federal fight has split the courts, with Minnesota's ban blocked in July 2026 and Wisconsin's enforcement upheld two days later. Unsettled

• The NBA, as a wild card: in March 2026 the league's Board of Governors voted to explore expansion to Seattle and Las Vegas, targeting the 2028-29 season, with Climate Pledge Arena the presumptive home for a returning Seattle franchise (the city has been without a team since the SuperSonics left in 2008). A team coming back would give Washington bettors one more reason to want a legal way to bet, though under current law that would still mean a tribal casino

Until the courts rule or the legislature revisits off-property mobile, legal betting means a tribal sportsbook in person, or a phone across the Oregon line.
